POLL: Do You Agree With the Supreme Court's Amendment Decisions?

On Monday, the justices voted 4-2 in favor of the Republican-controlled Legislature on the wording of the voter ID and same-sex marriage amendments.

On Nov. 6, the ballot titles and questions for the voter ID and same-sex marriage amendments will appear as the Republican-controlled Legislature wrote them, according to the Star Tribune. The Minnesota Supreme Court on Monday affirmed the wording legislators chose, instead of those submitted by Secretary of State Mark Ritchie. On the ballot, the title above the voter ID amendment will be, "Photo Identification Required for Voting." Ritchie changed it to "Changes to In-Person & Absentee Voting & Voter Registration; Provisional Ballots," but Chief Justice Lorie Skjerven Gildea and justices G. Barry Anderson, Christopher Dietzen and David Stras rejected his change. The title above the same-sex marriage amendment will say, "Recognition of …

Starting at 9 a.m. Tuesday, justices hear arguments on the titles of Minnesota ballot amendments on voting requirements and same-sex marriage.

Watch live here, starting at 9 a.m. Tuesday, as the Minnesota Supreme Court hears oral arguments on competing versions of the titles of the two proposed constitutional amendments set to appear on the ballot in November. Here are the titles for the two amendments, in versions proposed by the state Legislature and composed by Secretary of State Mark Ritchie. Marriage amendment: Voter Photo ID: Chief Justice Lorie Gildea consolidated two separate cases filed by Republican legislators against Ritchie, a DFLer, for the purposes of Tuesday's hearing. She denied a petition Friday from lawyers for the Republican-led Legislature for more time to make their oral arguments, the St. Paul Pioneer Press reported. Which Title for Ballot Amendment on Voting Changes?

Petitioners ask Minnesota Supreme Court to favor Legislature's original title over secretary of state's revision.

Supporters of a photo ID requirement for Minnesota voters asked the state Supreme Court Thursday to put the Legislature's original choice of words on the ballot as the title of the amendment. Minnesota Majority, ProtectMyVote.com and a group of legislators filed a petition and brief with the Supreme Court Thursday afternoon, requesting that the justices throw out Secretary of State Mark Ritchie's rewrite of the amendment title as it will appear on ballots this fall. The two versions of the amendment title have only one word in common ("Voting"): The move comes two days after the high court held a hearing on opponents' request that they take the proposed amendment off the ballot altogether. Supporters say the amendment will prevent voter …

This is the most common step in the process towards the Supreme Court. Most cases originate in a District or a Federal Court when the party who does not prevail believes a higher court will rule differently. Thanks. Supreme Court Upholds Intoxilyzer Breath-Testing Device's Validity

In a 4-3 ruling, the Minnesota Supreme Court upheld that the Intoxilyzer 5000EN is reliable even though the heavily-debated source code contains errors. What do you think? Is the breath-testing machine reliable?

The Minnesota Supreme Court today upheld that the Intoxilyzer breath-testing machine is reliable, ending a six-year battle in state and federal courts. In a 4-3 ruling, the Supreme Court agreed with District Court Judge Jerome Abrams that the Intoxilyzer 5000EN—a device once used in DWI cases across the state of Minnesota—is reliable even though the heavily-debated source code contains errors. Dissenting from today’s ruling were Supreme Court Justices Alan Page, Paul H. Anderson and Helen Meyer. Wednesday’s ruling means that more than 4,000 DWI and implied-consent cases that have been held up during the appeals process will now proceed. But the thing is, the breath-testing device that has long been in question will be phased out by the end…

Drinking and driving is illegal, Bobbo, this should not be controversial, this is common sense! If you get behind the wheel, after having more than one drink, you run MORE of a risk of hurting someone (including yourself) than if you got behind the wheel without that second or third drink....this is proven by studies. Didn't you see the tapes in school? I suppose you are against the seat belt law…   more ›

Minnetonka Zoning Fight Has Statewide Impact

Litigation between neighbors over the size of a garage has halted remodeling projects across the state.

Bob Boyer's construction business, Boyer Building Corp., has been building and remodeling homes in Minnetonka for sixty years. But recently they've lost a $1 million worth of business because jobs had to be scrapped. "Some projects that we would be doing, we won't be doing," he said. The reason: Neither Boyer's company nor his clients can get the necessary permits to start work, whether it's to add a deck to a house or renovate a garage. Boyer and builders around the state are the casualties of a legal battle between Minnetonka neighbors over how cities modify ordinances or grant zoning variances. Last summer, the Minnesota Supreme Court ruled that for a resident to get an exception to the standard state zoning law, known as a zoning …
