10.            Items requiring a majority vote:

  • Ordinance regarding campaign signs (Staff is proposing an amendment to the sign ordinance as it pertains to campaign signs. The ordinance would amend: (1) the time period during which campaign signs may be displayed; and (2) the time period during which the size of campaign signs is restricted. The amendment is necessary to ensure city ordinance is consistent with state statute regarding the display of campaign signs during statewide elections years. Further, the amendment is appropriate to ensure consistency in the display of campaign signs during statewide and city elections.)
  • Twelve-month extension for the DALMATIAN RIDGE preliminary plat at 2700 Oakland Road
  • Labor agreement between the city of Minnetonka and Law Enforcement Labor Services (public safety dispatchers)
  • Twelve-month extension for GAGNERS 2ND ADDITION preliminary plat at 18724 Ridgewood Road

12.            INTRODUCTION OF ORDINANCES: An ordinance must be considered by the city council at two regular meetings before adoption. At the first meeting, the ordinance is introduced by the council. The city council may discuss and/or refer the ordinance to an advisory board for review and public comment. The ordinance will be placed on a second city council meeting agenda for adoption.

  • Ordinance regarding noise permit RECOMMENDATION: Introduce the ordinance (4 VOTES)  (Staff has been contacted by the Minnetonka School District regarding the difficulty their maintenance staff has in complying with the noise ordinance. The ordinance prohibits maintenance activities such as parking lot sweeping after 10:00 at night and before 7:00 in the morning. A facility like the school district is in use from early in the morning until late at night, and they cannot sweep the parking lots when cars are there. As a result, they need to occasionally do maintenance work during nighttime hours, which is prohibited by the ordinance. The ordinance currently allows an individual to apply for a variance from the ordinance restrictions. This goes before the city council. Staff anticipates that there may be more institutions and businesses similarly situated as the school district. Staff is suggesting that instead of a variance from the council, an applicant could apply for an administrative permit. Attached is an ordinance that would change the variance process to a permit process. It provides that the applicant must show compelling reasons for the request and allows the community development director to impose conditions to mitigate the potential impact. The applicant would have to provide notice to the neighborhood potentially affected, as determined by the community development director. Either the applicant or a neighbor could appeal to the city council.)
  • Ordinance amending the regulation of pawnbrokers, precious metal dealers, and secondhand dealers RECOMMENDATION: Introduce the ordinance (4 VOTES)

13.            PUBLIC HEARINGS:

  • Precious metal dealers license for Facets Fine Jewelry, LLC dba J. Hudson, 12637 Wayzata Boulevard, RECOMMENDATION: Hold the continued public hearing and grant the license (5 VOTES)

14.            OTHER BUSINESS:

  • Resolution outlining the public purpose and benefit of a joint city of Minnetonka/Minnehaha Creek Watershed District facility and approving schematic design cooperative agreement RECOMMENDATION: Adopt the resolution (4 VOTES)

15.            APPOINTMENTS and REAPPOINTMENTS:

  • Appointments and reappointments to the senior citizen advisory board and the police advisory committee RECOMMENDATION: Approve the recommended appointments and reappointments (4 VOTES)
